Terms of Service – Research Use Only
1. Regulatory Status & Intended Use
Peptide Fountain sells reference materials, chemical intermediates, and peptides intended strictly for laboratory research, analytical testing, and in vitro experimentation. These products are offered exclusively to qualified researchers, laboratories, and institutions engaged in bona fide scientific research.
Under the Federal Food, Drug, and Cosmetic Act (FD&C Act), 21 U.S.C. § 301 et seq., the regulatory classification of a chemical product depends on its intended use. Products sold through this website are not intended to be drugs, biologics, medical devices, food additives, or cosmetics, and they have not been evaluated, approved, or cleared by the U.S. Food and Drug Administration (FDA) for human or veterinary diagnostic, therapeutic, preventive, or clinical use.
Regulatory Notice: The FDA evaluates the totality of marketing context—not merely label disclaimers—to determine whether a product is intended for human use. A “Research Use Only” (RUO) or “Not for Human Consumption” statement, standing alone, does not create a legal exemption from the FD&C Act or from FDA oversight if the surrounding circumstances suggest the product is intended for human consumption or therapeutic use. Peptide Fountain does not market these products for human consumption, therapeutic benefit, cosmetic use, or performance enhancement.
2. Prohibited Uses & Buyer Representations
By purchasing from Peptide Fountain, you represent and warrant that:
- You are a qualified scientific, chemical, or medical professional, or are affiliated with a bona fide research institution, university, or commercial laboratory;
- The products are acquired solely for laboratory research, chemical synthesis, or analytical reference purposes;
- You will not introduce these substances into humans or animals, or use them for any diagnostic, therapeutic, clinical, or dietary purpose, except as part of a valid FDA Investigational New Drug (IND) application, veterinary IND, or other applicable regulatory authorization;
- You understand that the sale, distribution, or administration of unapproved drugs to humans or animals may violate the FD&C Act (21 U.S.C. § 331) and related state and federal statutes, and may subject violators to civil and criminal penalties.
Any use involving bodily introduction into humans or animals without appropriate regulatory approval is strictly prohibited.
3. No Medical, Veterinary, or Legal Advice
All product descriptions, technical data, certificates of analysis, and educational materials provided on this website are for informational and educational purposes only. They do not constitute medical, veterinary, legal, or regulatory advice. Peptide Fountain makes no representations regarding the safety, efficacy, purity, or suitability of these products for any particular research application.
4. Assumption of Risk & Compliance Obligations
You assume full responsibility for ensuring that your purchase, possession, storage, handling, and use of these products comply with:
- All applicable federal, state, and local laws and regulations;
- Your employer’s or institution’s biosafety, chemical hygiene, and institutional review policies;
- OSHA standards for laboratory chemical safety;
- Applicable DEA, EPA, and FDA regulations governing the handling of chemical intermediates.
You agree to utilize appropriate personal protective equipment, engineering controls, and disposal methods consistent with Good Laboratory Practices (GLP).
5. Limitation of Liability & Indemnification
To the fullest extent permitted by applicable law, Peptide Fountain shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or related to your use of these products, except to the extent caused by Peptide Fountain’s gross negligence or willful misconduct.
You agree to indemnify, defend, and hold harmless Peptide Fountain, its officers, employees, and affiliates from any claims, losses, damages, or expenses (including reasonable attorneys’ fees) arising out of or relating to:
- Your misuse of the products;
- Your violation of these Terms of Service;
- Your failure to comply with applicable laws, regulations, or institutional policies;
- Any bodily injury, illness, or harm resulting from the unauthorized introduction of these substances into humans or animals.
6. Product Specifications
Products are provided as reference standards for research use. While Peptide Fountain strives to provide accurate certificates of analysis and product specifications, researchers bear sole responsibility for independently verifying the identity, purity, stability, and fitness of each compound for their specific analytical method or study design.
Governing Law & Severability
These Terms shall be construed in accordance with applicable law, without regard to conflict-of-law principles. If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed, and all remaining provisions shall continue in full force and effect.
